Terms of Service

These Terms of Service (“Terms”) cover your use of the Bloopsie app and getbloopsie.com (together, “Bloopsie”), made by Cache Lab LLC (“Cache Lab”, “we”, “us”). By creating an account or using Bloopsie, you agree to these Terms and to our Privacy Policy.

Short version: Bloopsie is for being silly with your friends. Be kind, use it the way it’s meant to be used, and we’ll keep it fun.

1. Bloopsie

Bloopsie is a no-typing status app. You tell your friends what you’re up to by picking a starter, an action and maybe a spice. You can also heart bloops, send pokes and notes, and pick secret besties. Everything you post or send is picked from lists we write.

2. Who can use it

• You must be at least 13.
• If you’re under 18, you need a parent or guardian’s permission, and they need to agree to these Terms too.
• You can’t use Bloopsie if we’ve removed your account before, or if the law doesn’t allow you to.

3. Your account

• You sign in with your phone number and a code we text you. Keep your phone and its passcode safe, since anyone who gets the code can get into your account.
• One account per person. Don’t share, sell or hand off your account.
• Your name is a first name from our list and a last initial. Pick one that fits you, and don’t use it to pass yourself off as someone else.
• You’re responsible for what happens in your account.

4. Being a good friend

Bloopsie is for friends. When you use it, please don’t:

• Add people you haven’t met in person, or post someone’s QR code online.
• Use pokes, notes or hearts to bother or gang up on someone.
• Try to find out who picked you as a secret bestie, or who muted or blocked you.
• Make another account to get around a block, a limit or a removal.
• Use bots, scripts or anything automated, or copy data out of Bloopsie.
• Break, overload or probe Bloopsie, or reverse engineer it except where the law allows.
• Use Bloopsie for anything illegal.

5. Daily sends

Everything you send someone, pokes and notes included, comes from one pool of 20 a day that refills at 4am your time. Bloops and hearts are unlimited. We may change these limits.

6. What you post

Your bloops, pokes and notes are made of our words, picked by you. You let us store them and show them to the people our Privacy Policy describes, only to run Bloopsie.

7. What’s ours

Bloopsie, including the app, the website, the lists of starters, actions, spices, notes and names, the blob avatars and the hand-drawn emoji art, belongs to Cache Lab LLC and is protected by copyright and trademark law. We give you a personal license to use the app on your iPhone under these Terms. You can’t transfer it to anyone else.

8. Staying safe

• Mute someone to quiet them, or block them so they can’t see you or send you anything. Nobody is told either way.
• If someone is making you feel bad, block them and talk to someone you trust. You can also email us at hello@cachelab.co.
• We may remove something, or limit, suspend or remove an account, that breaks these Terms or puts others at risk.

9. Ending things

• You can stop using Bloopsie anytime, and delete your account in the app. That deletes your data, as our Privacy Policy explains.
• We may suspend or remove your account if you break these Terms, or when we have to for legal or safety reasons.
• We may change Bloopsie or shut it down. If we shut it down, we’ll tell you in the app first.

10. Apple’s App Store

The Bloopsie app comes from Apple’s App Store, so Apple’s Licensed Application End User License Agreement applies to it too. These Terms are between you and Cache Lab, not Apple, and Apple isn’t responsible for Bloopsie or its support.

11. Disclaimers

BLOOPSIE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON’T PROMISE THAT BLOOPSIE WILL ALWAYS BE AVAILABLE OR FREE OF BUGS.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CACHE LAB LLC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA OR PROFITS, ARISING OUT OF OR RELATED TO BLOOPSIE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO BLOOPSIE IS LIMITED TO $50.

13. Indemnification

You agree to defend and indemnify Cache Lab LLC against claims, damages and costs that come from your misuse of Bloopsie in violation of these Terms or the law.

14. Governing law and venue

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws rules. The exclusive venue for any dispute is the state and federal courts located in Colorado, and you consent to personal jurisdiction there.

15. Changes to these Terms

We may update these Terms. If we make big changes, we’ll tell you in the app and update the date at the top. Using Bloopsie after a change means you accept the new Terms.
